Fortis Consultants, LLC (“Fortis Evaluations,” Fortis Consultants,” “we,” “us,” “our”) provides its services to you through its websites (collectively, the “Site”) and related offerings (collectively, the “Service” or “Services”). These Terms of Service (“Terms of Service” or “Terms”) govern all use of the Services and any other platform or application that references them.

“You” and “your” refer to you, a visitor to or user of the Site or Services. If you accept these Terms on behalf of a company or other legal entity, you warrant that you have authority to bind that entity, and “you” and “your” refer to that entity.

We may change or modify these Terms at any time in our sole discretion. Changes are posted on this page with the “Updated” date above. If we make material changes, we will notify you by email (if you have provided one) and/or a pop-up on the Site. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, do not use or continue to use the Service.

IMPORTANT NOTICE: These Terms require binding arbitration and a waiver of class-action rights as detailed below. BY ACCEPTING, YOU GIVE UP YOUR RIGHT TO SUE IN COURT OR TO BE PART OF A CLASS ACTION.

Access and Use of the Service

The Service provides efficient online interpretation, translation, academic evaluation, and other document‑related services.

The opinions provided in an academic evaluation, work experience letter, advisory opinion or expert opinion letter are strictly advisory only and should not be construed as legal advice.

Registration. Certain features require registration. You agree to provide true, accurate, current, and complete information and to keep it up to date. Registration data is governed by our Privacy Policy. The Service is not available to users under 16. Users under 18 may use the Service only with a parent or guardian’s permission.

Account, Password, and Security. You are responsible for all activity under your account. Notify us immediately of any unauthorized use or other breach. We are not liable for loss or damage arising from your failure to safeguard credentials.

Modifications. We may modify or discontinue the Service (in whole or part) at any time without liability.

Use, Storage, and Data Retention. We may establish general practices and limits, including document-retention periods and storage quotas, and may terminate inactive accounts.

Conditions of Use

You are solely responsible for all content you upload, email, transmit, or otherwise use via the Service.

Prohibited Content & Conduct. You agree not to upload, transmit, or otherwise use the Service for content that:

• infringes intellectual-property or proprietary rights;
• you lack legal right to upload;
• contains viruses or malicious code;
• creates privacy or security risks;
• constitutes unsolicited advertising (“spam”);
• is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
• in our sole judgment restricts or inhibits any other person’s use or enjoyment of the Service; or
• violates any law or these Terms.

Fees

To use the Services you must pay the amount shown at checkout. You represent that your payment information is accurate and that you are authorized to use it. Invoices are due within 30 days; unpaid balances may incur 1.5% monthly interest (or the maximum allowed by law) plus collection costs. Price changes will be posted on the Site or emailed to you; your continued use after the change is effective is agreement to pay the new price. Disputes must be raised within 60 days of the charge.

International Use. You agree to comply with all local laws regarding online conduct and acceptable content.

Commercial Use. Except as expressly authorized, you may not reproduce, sell, resell, or exploit access to the Service for commercial purposes.

Terms of Sale & Refund Policy

Orders marked “In Progress” cannot be refunded. All other refunds are at our sole discretion. Prices exclude taxes; you are responsible for all applicable taxes except those on our net income.

If we fail to provide a requested Service, your exclusive remedy is completion of that Service as soon as commercially reasonable (or as otherwise guaranteed on the Site).

Intellectual Property Rights & Confidentiality

The Service and its content are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works except for your own User Content. The name “Fortis Evaluations” and related logos are trademarks of Fortis Consultants, LLC.

User Content. By uploading content, you warrant that you own or have rights to it and grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use it in operating the Service (this does not apply to “Confidential Information” as defined below).

Confidential Information. Content you provide for the Services is your Confidential Information and will be used only to perform the Services, subject to the exceptions and protections described in these Terms and our Privacy Policy.

Copyright Complaints

We respect intellectual-property rights. Send DMCA takedown requests to [email protected] (Subject: “DMCA Takedown Request”) with the information required by the DMCA. Counter-notices should include the information listed in the Terms. Repeat infringers’ accounts may be terminated.

Third-Party Websites

Links to third-party sites are provided for convenience; we do not control or endorse them and are not responsible for any damages arising from their content, products, or services.

Indemnity & Release

You agree to indemnify and hold harmless Fortis Evaluations, its affiliates, officers, directors, employees, and agents from any claim or demand arising out of your use of the Service, User Content, or violation of these Terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR LOSS OF PROFITS. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE LAST SIX MONTHS OR (B) $100.

Disputes, Choice of Law & Forum

Agreement to Binding Arbitration

Most disputes must be resolved by binding arbitration under the American Arbitration Association rules in Anne Arundel County, Maryland, except for emergent injunctive relief.

Class-Action Waiver

Arbitration shall proceed only on an individual basis. Class-action claims are waived. If this waiver is held unenforceable, the arbitration provision is void.

Notice of Dispute

Send written notice of any dispute to [email protected] and negotiate in good faith for 60 days before filing for arbitration.

Termination

We may suspend or terminate your account and remove content for any reason, including violation of these Terms.

User Disputes

You are responsible for interactions with other users. We may, but are not obligated to, intervene.

General

These Terms constitute the entire agreement between you and Fortis Evaluations. They are governed by Maryland law (without regard to conflicts rules). If any provision is unenforceable, the remainder remains in force. Claims must be brought within one year. You may not assign these Terms without our consent; we may assign them freely.

Your Privacy

Please review our Privacy Policy. By using the Service, you consent to the collection and use of personal information as described therein.
